1. 適用

本利用規約（以下「本規約」）は、Cingulate（以下「運営者」）が提供する意思決定支援サービス「Seneca」（以下「本サービス」）の利用条件を定めます。利用者は、本サービスを利用することにより、本規約に同意したものとみなされます。

2. 本サービスの性質

本サービスは、利用者が支出その他の意思決定を整理し、自分の考えを深めるための支援ツールです。特定の商品や行動を推奨し、最終判断を代行するものではありません。また、金融、投資、法律、医療、税務その他の専門的助言を提供するものではありません。

3. AIによる出力

Seneca Insightその他の出力には生成AIを使用します。出力は不正確、不完全、古い、または利用者の状況に適さない場合があります。利用者は、必要に応じて信頼できる情報や専門家の助言を確認し、自らの責任で最終判断を行うものとします。

4. アカウント

一部機能ではGoogleアカウントによるログインを利用できます。利用者は、正当な権限を有するアカウントを使用し、アカウントおよび端末を適切に管理するものとします。不正利用が疑われる場合は、速やかに運営者へ連絡してください。

5. 利用者の入力内容

利用者は、自らが入力する内容について必要な権利を有することを保証します。利用者は入力内容に関する権利を保持し、運営者に対して、本サービスの提供、AI処理、保存、同期、改善および安全確保に必要な範囲で利用する権利を許諾します。機微情報や、権限なく第三者の個人情報を入力しないでください。

6. 禁止事項

  • 法令、本規約または公序良俗に違反する行為
  • 他者の権利、プライバシー、信用または利益を侵害する行為
  • 本サービスまたは関連システムの安全性・可用性を妨害し、不正アクセスを試みる行為
  • 過度な自動アクセス、スクレイピング、負荷を生じさせる行為
  • 本サービスを違法、有害、欺瞞的または権利侵害的な目的で利用する行為
  • 適用法令で認められる範囲を超えて、ソースコードの取得、逆コンパイルその他の解析を試みる行為
  • その他、運営者が本サービスの運営上不適切と合理的に判断する行為

7. 知的財産権

本サービス、デザイン、ソフトウェア、文章、商標その他の構成要素に関する権利は、運営者または正当な権利者に帰属します。本規約は、利用者に対し、本サービスを本規約に従って利用する限定的な権利のみを付与します。

8. サービスの変更・停止

運営者は、保守、障害、セキュリティ上の必要、法令対応その他の合理的な理由により、本サービスの全部または一部を変更、中断または終了することがあります。可能な場合は事前に告知しますが、緊急時はこの限りではありません。

9. 利用制限・終了

利用者が本規約に違反した場合、または本サービスの安全な運営に必要な場合、運営者は事前の通知なく利用を制限または停止できるものとします。利用者は、下記連絡先へ依頼することで、アカウントに紐づくデータの削除を求めることができます。

10. 保証の否認と責任の制限

本サービスは現状有姿で提供されます。運営者は、本サービスの正確性、完全性、継続性、特定目的への適合性またはエラーがないことを保証しません。運営者が責任を負う場合、その範囲は適用法令で許される限度に限定されます。ただし、消費者契約法その他の強行法規により制限が認められない責任を排除または制限するものではありません。

11. 本規約の変更

運営者は、必要に応じて本規約を変更することがあります。利用者の権利または義務に重大な影響を与える変更については、本サービス上その他適切な方法で事前にお知らせします。変更後に本サービスを利用した場合、利用者は変更後の規約に同意したものとみなされます。

12. 準拠法・管轄

本規約は日本法に準拠します。本サービスまたは本規約に関する紛争については、適用法令に別段の定めがある場合を除き、東京地方裁判所を第一審の専属的合意管轄裁判所とします。本規約の日本語版と英語版に齟齬がある場合は、日本語版が優先します。

1. Scope

These Terms of Use (the “Terms”) govern your use of Seneca (the “Service”), a decision-support service provided by Cingulate (the “Operator”). By using the Service, you agree to these Terms.

2. Nature of the Service

The Service helps you organise and reflect on spending and other decisions. It does not endorse a particular product or action or make the final decision for you. It is not financial, investment, legal, medical, tax, or other professional advice.

3. AI-generated output

Seneca Insight and other outputs use generative AI and may be inaccurate, incomplete, outdated, or unsuitable for your circumstances. You remain responsible for your final decision and should verify important information or obtain professional advice where appropriate.

4. Accounts

Google Sign-In may be available for certain features. You must use an account you are authorised to use and keep your account and device secure. Please contact us promptly if you suspect unauthorised use.

5. Your content

You represent that you have the necessary rights to content you submit. You retain your rights in that content and grant us a limited permission to use it as needed to provide the Service, perform AI processing, store and synchronise data, improve the Service, and maintain safety. Do not submit sensitive information or another person’s personal information without authority.

6. Prohibited conduct

  • Violating applicable law, these Terms, or public order and morals
  • Infringing another person’s rights, privacy, reputation, or interests
  • Interfering with the security or availability of the Service or attempting unauthorised access
  • Using excessive automated access, scraping, or imposing an unreasonable load
  • Using the Service for illegal, harmful, deceptive, or infringing purposes
  • Attempting to obtain source code, decompile, or otherwise analyse the Service beyond what applicable law permits
  • Other conduct that we reasonably consider inappropriate for operating the Service

7. Intellectual property

Rights in the Service, its design, software, text, trade marks, and other components belong to the Operator or their respective owners. These Terms grant only a limited right to use the Service in accordance with these Terms.

8. Changes and suspension

We may change, suspend, or discontinue all or part of the Service for maintenance, outages, security needs, legal compliance, or other reasonable reasons. We will give advance notice where practicable, but may act immediately in an emergency.

9. Restriction and termination

We may restrict or suspend access without prior notice if you breach these Terms or where necessary to operate the Service safely. You may ask us to delete account-linked data by contacting us below.

10. Disclaimers and limitation of liability

The Service is provided on an “as is” basis. We do not warrant that it will be accurate, complete, uninterrupted, fit for a particular purpose, or error-free. To the extent permitted by applicable law, our liability is limited. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer protections.

11. Changes to these Terms

We may update these Terms when necessary. We will provide advance notice through the Service or by another appropriate method if a change materially affects your rights or obligations. Continued use after the change takes effect constitutes acceptance of the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Unless applicable law provides otherwise, the Tokyo District Court has exclusive jurisdiction as the court of first instance over disputes relating to the Service or these Terms. If the Japanese and English versions conflict, the Japanese version prevails.
